Welcome to PetPark Art! The terms "we", "us" and "our" refer to PetPark Art, a DBA of Doves United LLC. PetPark Art operates this store and website, including all related information, content, features, tools, products and services in order to provide you, the customer, with a curated shopping experience (the "Services"). PetPark Art is powered by Shopify, which enables us to provide the Services to you.
Please read these Terms of Service carefully, as they include important information about your legal rights and cover areas such as warranty disclaimers and limitations of liability. By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, you should not use or access our Services.
SECTION 1 - ACCESS AND ACCOUNT
By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence. You are solely responsible for maintaining the security of your account credentials and for all of your account activity. You may not transfer, sell, assign, or license your account to any other person.
SECTION 2 - OUR PRODUCTS
We have made every effort to provide an accurate representation of our products and services. However, colors or product appearance may differ from how they appear on your screen due to your device settings. All descriptions of products are subject to change at any time without notice at our sole discretion.
Each portrait is a unique custom commission created by a human artist using AI-assisted design tools under direct artistic direction. Visible brushwork, expressive color variation, and painterly character are intentional parts of our signature style and do not constitute defects.
SECTION 3 - ORDERS
When you place an order, you are making an offer to purchase. PetPark Art reserves the right to accept or decline your order for any reason. Your order is not accepted until PetPark Art confirms acceptance and processes your payment. Because production begins promptly, cancellations are not accepted once an order is placed and the design process has begun. Your purchases are subject to our Refund Policy.
SECTION 4 - PRICES AND BILLING
Prices, discounts and promotions are subject to change without notice. The price charged will be the price in effect at the time the order is placed. Unless otherwise stated, posted prices do not include taxes, shipping, handling, customs or import charges. You agree to provide current, complete and accurate purchase and payment information for all purchases.
SECTION 5 - SHIPPING AND DELIVERY
We are not liable for shipping and delivery delays. All delivery times are estimates only and are not guaranteed. We are not responsible for delays caused by shipping carriers, customs processing, or events outside our control. Once we transfer products to the carrier, title and risk of loss passes to you.
We currently ship to the United States (free domestic shipping), Canada, United Kingdom, and Australia. International shipments may be subject to customs duties and import taxes, which are the responsibility of the buyer.
SECTION 6 - INTELLECTUAL PROPERTY
Our Services, including all trademarks, brands, text, displays, images, graphics, video, and audio, are owned by PetPark Art, Doves United LLC, its affiliates or licensors and are protected by U.S. and foreign intellectual property laws.
PetPark Art retains copyright to all derivative artistic creations and digital portrait designs. All artwork is created by a human artist with the assistance of AI-assisted design tools and constitutes an original creative work. Your purchase grants you personal display rights only. Commercial resale, digital duplication, or merchandise reproduction of the final design is strictly prohibited. You retain all rights to your original photograph.
SECTION 7 - OPTIONAL TOOLS
You may be provided with access to third-party tools which we neither monitor nor control. We provide access to such tools "as is" without any warranties. Any use of optional third-party tools is entirely at your own risk.
SECTION 8 - CUSTOM COMMISSION & ARTISTIC LICENSE
Each portrait reflects the signature PetPark Art style — painterly, expressive, and vibrant. Every order includes one round of minor stylistic adjustments before final production. Within 2-3 business days of your order, we will send you a preview link for your review. You have a 48-hour window to request minor changes — after that, your portrait is automatically sent to the print shop.
We do not offer open-ended or unlimited revisions. If after your revision round our painterly style still doesn't fully match your vision, we will gladly create a more simplified, timeless pet portrait on a solid color backdrop to ensure your happiness.
SECTION 9 - RELATIONSHIP WITH SHOPIFY
PetPark Art is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with PetPark Art. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and PetPark Art. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with PetPark Art.
SECTION 10 - PRIVACY POLICY
All personal information we collect through the Services is subject to our Privacy Policy. By using the Services, you acknowledge that you have read our Privacy Policy. Because the Services are hosted by Shopify, certain personal information may also be subject to Shopify's Privacy Policy.
SECTION 11 - AI DISCLOSURE
PetPark Art uses third-party AI-assisted design software as part of our creative process, under the direction of a trained artist. By purchasing, you acknowledge and consent to this process. Your photos are processed solely for portrait creation and are not used to train AI models. PetPark Art is not responsible for any liability regarding the background data processing or independent privacy policies of those external software developers.
SECTION 12 - FEEDBACK
If you submit any ideas, suggestions, feedback, or reviews, you grant us a perpetual, worldwide, royalty-free license to use, reproduce, modify, publish, and distribute such feedback for any purpose. You represent that you own or have all necessary rights to all feedback submitted.
SECTION 13 - ERRORS, INACCURACIES AND OMISSIONS
We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information is inaccurate at any time without prior notice.
SECTION 14 - PROHIBITED USES
You may access and use the Services for lawful purposes only. You may not use the Services for any unlawful purpose, to violate any regulations or laws, to infringe upon intellectual property rights, to harass or harm any person, to transmit false or misleading information, or to engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Services.
SECTION 15 - AGENTS
No automated agent, bot, or AI tool may access, use, or interact with the Services unless it identifies itself in all HTTP/HTTPS requests, operates transparently, does not mimic human behavior, and does not circumvent any security or access control measures. We may limit by technical means whether and how any agent accesses the Services.
SECTION 16 - TERMINATION
We may terminate this agreement or your access to the Services at any time without notice. You will remain liable for all amounts due up to and including the date of termination.
SECTION 17 - DISCLAIMER OF WARRANTIES
EXCEPT AS EXPRESSLY STATED BY PETPARK ART, THE SERVICES AND ALL PRODUCTS ARE PROVIDED 'AS IS' AND 'AS AVAILABLE' WITHOUT ANY REPRESENTATION, WARRANTIES OR CONDITIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, AND NON-INFRINGEMENT.
SECTION 18 - LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PROVIDED BY LAW, PETPARK ART, DOVES UNITED LLC, OUR PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCTS PROCURED USING THE SERVICES.
SECTION 19 - INDEMNIFICATION
You agree to indemnify, defend and hold harmless PetPark Art, Doves United LLC, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from any losses, damages, liabilities or claims, including reasonable attorneys' fees, arising out of your breach of these Terms, your violation of any law, or your access to and use of the Services.
SECTION 20 - SEVERABILITY
If any provision of these Terms is determined to be unlawful, void or unenforceable, that provision shall be severed and shall not affect the validity and enforceability of any other remaining provisions.
SECTION 21 - WAIVER; ENTIRE AGREEMENT
These Terms of Service constitute the entire agreement between you and PetPark Art and govern your use of the Services, superseding any prior agreements. The failure of us to exercise or enforce any right or provision shall not constitute a waiver of such right or provision.
SECTION 22 - ASSIGNMENT
You may not delegate, transfer or assign this Agreement without our prior written consent. We may transfer, assign, or delegate these Terms and our rights and obligations without consent or notice to you.
SECTION 23 - GOVERNING LAW
These Terms of Service shall be governed by and construed in accordance with the laws of the State of Florida and applicable United States federal law. You and PetPark Art consent to venue and personal jurisdiction in Manatee County, Florida.
SECTION 24 - CHANGES TO TERMS OF SERVICE
We reserve the right to update, change, or replace any part of these Terms of Service at any time. Your continued use of the Services following any changes constitutes acceptance of those changes.
